Abuja-based group, the Society for Rule of Law in Nigeria (SRLN) has called for the immediate arrest and prosecution of the former Acting Chairman of the Economic and Financial Crimes Commission (EFCC), Mr Ibrahim Magu over his indictment by the Department of State Services (DSS).
SRLN, in a statement on Friday, signed by its National Co-ordinator, Dr Chima Ubeku, challenged said the DSS must go a step further by applying the same treatment it applied to the judges it indicted to Magu.
The group also said that Magu must stop parading himself as Acting Chairman of EFCC, pointing out that there is not provision for the position of acting chairman in the EFCC Act 2004.
It warned of the legal consequences of Magu continuous occupation of the EFCC chairmanship position in acting capacity said; “Since four other members of the commission have been cleared by the Senate, one of them can be made to act as Chairman pending the nomination of another person as Chairman by President Muhammadu Buhari, and subsequent confirmation of the nominee by the Senate.”

SRLN noted that “if the DSS could say in its report that Magu divulged official secrets, including classified EFCC letters to a certain Umar Mohammed (Air Commodore/Rtd), described as a questionable businessman and from which dealings he is believed to have been drawing considerable benefits, there is no reason he (Magu) should not have been arrested and made to face prosecution.”
The statement read in part; “It was on the strength of DSS report that residences of judges were invaded in the night by armed men of the service.
“It was also on the strength of report by the DSS that the affected judges were suspended by the National Judicial Council (NJC).
“Therefore, for the DSS report indicting Magu not to be seen as mere tool to prevent the confirmation of his appointment as substantive EFCC chairman, he must be prosecuted.”
